End User License Agreement and Terms of Service

This agreement governs the iRoamer Windows agent, web application, website, updates, and related services (together, the "Service"). By clicking "I agree", installing, accessing, or using iRoamer, you agree to this agreement. If you do not agree, do not install or use iRoamer.
1. Scope and acceptable use
iRoamer is provided for authorized testing, development, QA, privacy testing, and personal device workflows on devices you own or are permitted to control. You are responsible for complying with all applicable laws and with the terms of any third-party app or service you use iRoamer with.
You must not use iRoamer to deceive or defraud, evade legal or safety requirements, gain an unfair or unauthorized advantage, interfere with another person's rights or property, or violate a third party's terms. Some apps may detect, reject, or prohibit simulated locations.
2. License grant and restrictions
Subject to this agreement, iRoamer grants you a limited, personal, revocable, non-exclusive, non-transferable license to install and use the Service on supported devices. No ownership rights are transferred to you.
Except where applicable law expressly permits it, you may not sell, sublicense, rent, redistribute, reverse engineer, decompile, circumvent licensing or technical controls, remove proprietary notices, or use the Service to create a competing product. Open-source components remain governed by their own licenses.
3. Requirements and local operation
The Service depends on a supported Windows PC, Apple device drivers, a USB connection, an iPhone with Developer Mode enabled, internet connectivity, and third-party services. iRoamer requires internet verification to start location simulation; if the connection drops during a session, it automatically clears the simulated location and disconnects.
USB device control and saved Pro favorites and routes are processed locally by the Windows agent. You are responsible for maintaining compatible equipment and backups.
4. Free tier and ads
iRoamer is free to use on an ad-supported or sponsor-supported basis. Ads may appear on the website or free app experience if approved and enabled. Disabling consent, ads, or sponsor mechanisms may limit free-tier functionality. Pro removes ads from the iRoamer app experience.
5. Pro subscriptions and licensing
Pro may be offered as a subscription or paid license, including EUR 7.50 monthly, EUR 18.75 quarterly, or EUR 59.99 yearly plans where available. Creem acts as merchant of record and handles checkout, payment, taxes, receipts, refunds, subscription management, and customer billing support. Recurring plans renew for the period shown at checkout until canceled through the Creem customer portal or another method provided at purchase. Statutory cancellation, refund, and withdrawal rights remain unaffected.
The Free tier includes fixed location simulation and one walk with up to three destination pins per session and is supported by advertising. Pro removes advertising and adds unlimited walking pins, custom speed, joystick movement, multiple-device control, automatic reconnect, and local Agent-saved favorites and routes. Features may change as the Service is improved.
Pro license keys are subject to the activation limit shown at purchase or configured for the product and may be bound to a hashed installation identifier. You must keep your key confidential and may not share, resell, or publish it. After successful checkout, iRoamer may securely retrieve the generated key from Creem and submit it to the local agent for activation. Manual activation remains available.
6. Validation and updates
The agent may validate an active license when it starts and periodically while it is used. A limited offline grace period may be provided but is not guaranteed. Access may end when a subscription expires, is refunded, is disputed, is canceled at the end of its paid period, or when a key is disabled for misuse.
The Service may check for and install updates needed for security, compatibility, licensing, or functionality. Updates are governed by this agreement unless accompanied by different terms.
7. Privacy and third-party services
Our Privacy Policy explains what data is processed by the website, web app, local Windows agent, licensing, checkout, maps, analytics, ads, affiliate links, and update services. Creem, Apple, map providers, analytics providers, advertisers, and other third parties operate under their own terms and privacy policies.
8. Intellectual property
iRoamer, its branding, and all non-open-source parts of the Service are owned by iRoamer or its licensors. iRoamer is not affiliated with, endorsed by, or sponsored by Apple Inc. "iPhone" and "Apple" are trademarks of Apple Inc.
9. Suspension and termination
You may stop using and uninstall the Service at any time. We may suspend or terminate access where reasonably necessary to address a material breach, fraud, security risk, unlawful use, payment reversal, or harm to the Service or others. On termination, the license granted by this agreement ends.
10. Disclaimer of warranty
To the maximum extent permitted by law, the Service is provided "as is" and "as available". We do not guarantee uninterrupted operation, compatibility with every device or third-party application, or that a simulated location will be accepted by a third party. Nothing in this agreement excludes warranties or rights that cannot lawfully be excluded.
11. Limitation of liability
To the maximum extent permitted by law, iRoamer is not liable for indirect, incidental, special, punitive, or consequential loss, lost profits, lost data, or third-party account actions arising from use of the Service. Where liability cannot be excluded, our aggregate liability for the event giving rise to the claim will not exceed the amount you paid for the Service during the twelve months before that event.
These limits do not apply to fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or other liability that law does not allow us to limit.
12. Governing law and consumer rights
This agreement is governed by Swiss law, excluding conflict-of-law rules. If you are a consumer, mandatory protections and jurisdiction rights in your country of residence remain unaffected.
13. Changes and complete agreement
We may update this agreement for legal, security, or material Service changes. Material changes will be identified by a new effective date and, where required, additional notice. This agreement, the Privacy Policy, and the terms shown at checkout form the complete agreement for the Service. If one provision is unenforceable, the remaining provisions continue in effect.
